General Terms and Conditions of use

DEFINITIONS

Content – all information on the website www.emagie.ro, the content of any newsletter or email sent to Users or Buyers by Magic Hub SRL by electronic means and/or any other form of communication, information related to products, services and/or prices practiced by Magic Hub SRL in a certain period.

Magic Products / Magic Tricks – Illusionism (also called magic or stage magic) is a performing art that entertains audiences by presenting tricks or creating seemingly impossible illusions using natural means. These means are called magic tricks, effects, or illusions. A magic trick may include a physical component and a secret. On this site, only the effect is described (what can be done with it) without disclosing the secret. The secret is offered/received after purchase.

Goods and Services – any product or service to be supplied by the Seller to the Buyer. These are categorized as Magic Products / Magic Tricks and Others (any product that is not accompanied by the secret of the magic trick and/or its explanation).

User – any natural or legal person who has or obtains access to the content, by any means of communication (electronic, telephone, etc.), even without creating an account, and who has accepted the Terms and Conditions of this website.

Seller – SC Magic Hub SRL, having its registered office at Strada Vitan-Barzesti, nr 7D, Bl 1, Sc. A, Ap 18, Sector 4, Bucharest, Romania.

Buyer – natural person / legal person or any other legal entity who places an Order through www.emagie.ro.

Order – an electronic document that acts as a form of communication between the Seller and the Buyer by which the Seller agrees to deliver Goods and Services, and the Buyer agrees to receive these Goods and Services and pay for them.

Gift Card / Voucher – Discount voucher / coupon

BOX / PACK – A set of products, dynamically created by the Buyer through the website

Client Account – the set formed from an email address and password which allow a single user access to restricted areas of the site.

Contract – an Order confirmed by the Seller.

COPYRIGHT

The entire content of the website www.emagie.ro, images, texts, graphics, symbols, web graphic elements, scripts, programs, and other data – is the property of Magic Hub SRL and its suppliers and is protected by Copyright Law and laws regarding intellectual and industrial property. The use, without written consent from Magic Hub SRL, of any of the elements listed above is punishable according to current laws.

CONTACT

Magic Hub SRL publishes on the website full and correct data for its identification and contact by the Buyer or User.
By using the contact form or the service available on the site, the User or Buyer allows Magic Hub SRL to contact them by any available means, including electronic means.
Partially or fully completing the contact form and sending it does not in any way obligate Magic Hub SRL to contact the User or Buyer.
Magic Hub SRL reserves the right to not respond to all requests of any nature, received by any communication method (electronic, telephone, etc).

YOUR DATA AND VISITS TO THIS WEBSITE

The information or personal data you provide will be processed in accordance with the Data Protection Policies. By using this Website and/or placing an order through www.emagie.ro, you expressly and unequivocally give your consent to the processing of this information and data and declare that all information and data you have provided are true and accurate, and that you obtained the prior written consent of the owner of the information and/or data in case the information provided does not belong to you.

USE OF OUR WEBSITE

By using this Website and/or placing any product order through it, you agree:
To use this Website exclusively to send legitimate questions or legitimate orders.
Not to place any false or fraudulent order. If we have reasonable grounds to believe such an order was placed, we will have the right to cancel the order and notify the competent authorities accordingly.
To provide us with a correct and accurate email address, postal address and/or other contact information. Likewise, you consent that we may use this information to contact you if necessary.
If you do not provide us with all the information we need, we may not be able to complete your order.
By placing an order through the Website, you declare that you have the legal capacity to enter binding contracts.

PRODUCTS AND SERVICES

Magic Hub SRL may publish on the site information about products, services and/or promotions practiced by it, for a certain period and within the available stock.
Products and/or services purchased through the website www.emagie.ro are intended exclusively for the personal use of the Buyer.
Magic Hub SRL may limit the ability to purchase certain products or services available on the site at a given time to one or more Users or Buyers.
All prices related to products or services shown on the site include VAT.
Discount coupons / Vouchers / Discount Cards do not apply to products already discounted or in a current promotion. They do not apply to BOX / PACK products. Discount coupons cannot be combined, unless otherwise specified by the site at the time of placing the order.
Billing of purchased products is done exclusively in RON. The invoice is generated electronically and made available to the client through the website. Upon explicit request from the client, it can be printed on paper free of charge.
In case of payments made by bank transfer, Magic Hub SRL is not and cannot be responsible for any additional costs incurred by the client, the responsibility being exclusively that of the buyer.
In case of payment at courier/locker, an additional cost is applied, displayed in the final step of the order. This will be added automatically to the delivery cost and represents the cost for processing payment on delivery. Online card payment is free.
The description of products and services available on the site is for presentation purposes only and does not represent a contractual obligation from Magic Hub SRL.

GIFT CARD

The Gift Card is not nominal; it may be used by the Buyer or freely given to another person.
The Gift Card is not a bank card and is not linked to a bank account. It works as a discount coupon, discount code, voucher. It is also not a guarantee or credit card.
Buyers cannot return the Gift Card and cannot request its refund.
The balance available on the Card cannot be exchanged for other payment methods and cannot be transferred as other cards/vouchers.
Magic Hub reserves the right to refuse issuing or selling a Gift Card without justification. The Buyer has no right to request compensation in such a case.
The Gift Card is activated from the date of payment confirmation and is valid for a period of 6 months from that date.
The Gift Card may be used by the Client to purchase any product from emagie.ro
If the purchase value exceeds the available balance on the Gift Card, the difference may be paid by the Client through any payment method accepted on the site.
If the value of the card is higher than the order, the Buyer understands that they waive the card and the remaining unused value after the successful order.
The Buyer is solely responsible for keeping the Gift Card data safe, its use, and for entrusting the card to third parties either through their own means or through the facilities provided by the site.
The Buyer must ensure that no one uses the Card without their consent and that the Gift Card will only be given for the purpose of making a transaction.
Magic Hub is not responsible in case of use outside the validity period, loss, theft, damage, deactivation, or unauthorized use of the Card.
Magic Hub is not responsible for abnormal or unpredictable circumstances beyond its control (including but not limited to computer system failures caused by reasons outside Magic Hub’s reasonable control) that result in the inability to use the Card.

PRODUCT ORDERING

By placing an electronic Order on www.emagie.ro or by phone, the Buyer agrees with the documents making up the order: the Order (along with clear details regarding delivery and billing) and the Terms and Conditions.

If the Seller confirms the Order, this implies complete acceptance of the Order terms. The Order is in the Processing stage until accepted by the Seller, and is considered completed when there is a verbal (phone) or electronic confirmation (email or SMS) from the Seller to the Buyer, or by changing the order status to “Shipped” without requiring confirmation of receipt from the Buyer. An unconfirmed order does not have the value of a Contract.

An order may be placed by creating a Client Account or through the Quick Order option.

If stock is depleted before completion of the order, the order may be canceled even if previously confirmed, but only after informing the Buyer of this situation.

In case of technical errors on www.emagie.ro or human errors that cause incorrect price display, not matching the usual selling price set by the Seller, the Seller reserves the unquestionable right to cancel the order and customers who placed orders will be informed (by phone, email) of this fact.

We reserve the right to remove any product from this Website at any time, at our discretion, and/or to remove or modify any material or information on this Website.

Although we make every effort to always process all placed orders, there may be exceptional circumstances that oblige us to refuse processing an order after sending a Confirmation message, and we reserve the right to do so at any time.

We will not be liable to you or any third party for removing any product from this Website or for removing or editing any material or content from this Website.

DISTANCE CONTRACT

The date of concluding the distance selling contract between Magic Hub SRL via www.emagie.ro and the Buyer is the date of Order confirmation by the Seller. Therefore, the date of concluding the distance contract may differ from the date the order was placed.

The Seller cannot be held responsible for damages of any kind that the Buyer or any third party may suffer from using the Goods and Services after delivery.

PAYMENT AND BILLING

The Seller will issue to the Buyer an electronic invoice for the Goods and Services delivered according to the conditions in the Order. The Buyer is obligated to provide all necessary information for issuing the invoice according to the law. Payment for ordered products may be made in accordance with the accepted payment methods of the Seller. Starting from 14.05.2022, invoices are generated only electronically and are available to all clients through the website. Cash-on-delivery payment is available only for orders up to 700 lei. For orders above 700 lei, payment can be made exclusively online by card at the time of placing the order.

For bank transfer payments, goods and services will be delivered after payment confirmation in the Magic Hub SRL bank account.

If the ordered products are not available and payment has been completed, the money will be refunded in full, without any additional fee. Refunds will be made via bank transfer, and the Buyer must provide a valid bank account.

DELIVERY

The Seller undertakes to ship Goods and Services within Romania, Bulgaria, and Hungary via courier, according to the Buyer’s option. The Seller will ensure appropriate packaging of the Goods and Services and the transmission of accompanying documents.

Delivery times usually vary between 24 hours and 2 business days, depending on product location and delivery address. Delivery times are estimated and may be extended due to weather conditions or courier workload during certain periods (for example, holidays). All processing and delivery times displayed on the site refer to business hours/days.
We reserve the right to choose any of the couriers displayed in the ordering step, to optimize delivery costs, regardless of the Buyer’s preference.

Ownership of the Goods and Services is transferred upon delivery, after payment has been made by the Buyer.

WITHDRAWAL AND RETURN POLICY

The consumer has the right to notify in writing that they withdraw from the purchase, without penalties and without giving a reason, within 14 calendar days from receiving the product or, in the case of services, from concluding the distance contract, and applies only to natural person consumers who purchased the product remotely in accordance with OUG 34/2014. Magic Products and Magic Tricks include the secrets/explanations of the tricks. Once a secret is known, it cannot be returned.

A refund or replacement without penalties and without reason may take place under the following conditions:
• If the products have a seal, it must not be opened – the product must be returned sealed;
• The condition of purchased products must remain as at purchase/receipt, including packaging must remain intact

Your right to cancel a Contract applies only to products returned in the same condition in which you received them. Please return any product using or including its original packaging. You must also send us all boxes, instructions/documents (if any), and original packaging together with the returned product. No refund will be made if the product has been used after unsealing, is not in the same condition as delivered, or is damaged. Therefore, you must take reasonable care of the products while in your possession.

If the purchased product does not meet your expectations, you may unilaterally terminate the contract within the period mentioned above and return the product(s), and we will refund the amount to the indicated account.

The request for unilateral termination of the distance contract must be made in writing via a withdrawal form which can be found below. The product must be returned together with a copy of the purchase invoice.

Withdrawal within 14 calendar days applies only to products delivered by courier. The returned product must be in the same condition as delivered (sealed in original packaging with all accessories, intact labels, and documents). Return shipping costs will be borne by the client and the refund will be made within 30 days from return. Packages sent with payment on delivery will not be accepted. Products returned in inappropriate condition (damaged, scratched, missing accessories, etc.) will result in refusal of return.
If the product is returned in a condition in which it can no longer be sold as new, the Seller reserves the right to charge a fee to restore it to its original state (if possible) or to cover the price difference resulting from selling it as second-hand or, at the client’s choice, the product will be sent back at the client’s expense.

Returned products will be sent to the address communicated by the Seller when informed of the return. Products will NOT be returned via Posta Romana and will not be sent to any address other than the one specified by the Seller.

The refund of returned products will be made within a maximum of 30 days from receiving the parcel, to the IBAN indicated by the Client in the return form. Delivery fees paid by the Client are non-refundable.
According to OUG 34/2014, the period for returning products or canceling a Service expires 14 days after the day the Buyer takes physical possession of the products.

By placing an online order, the client declares that they have acknowledged and fully agree with the above.

Magic Hub SRL reserves the right to refuse product returns in cases of repeated returns, exceeding the return deadline, failure to meet return conditions, or refusal to accept courier fees.

In case of returning products ordered, the following steps shall be followed:

1. The Buyer will send a return notification by email to contact@emagie.ro including the reason for return, using the same email address used at the time of purchase. This requirement is necessary to validate the return request.

The Return Form email/document will be printed and completed by the Buyer with the IBAN account details where the refund is to be received, and sent to the Seller along with the returned products. The Client must include in the parcel together with the returned products the invoice and/or a copy of the AWB (delivery note).

The return request will be approved and registered only if the required data is correct and complete and if the return conditions listed in this article are met.

2. Return of products may also be done through Easybox, in which case the return fee is 14.99 lei and will be automatically deducted from the credit note issued after returned products are inspected. To receive the Easybox Return link, you must submit a request according to Step 1 above.

NEWSLETTER SUBSCRIPTION

By subscribing to the newsletter, you agree to receive periodic communications about news, offers, and events related to our specific activity, in accordance with our privacy policy. You may unsubscribe at any time. Discount codes received as a result of subscription cannot be combined with other discount codes unless otherwise specified on the website at the time of order placement.

CONFIDENTIALITY AND PERSONAL DATA PROCESSING

The purpose of collecting data is to inform Buyers regarding their Account status including validation, shipping of products and invoicing of Orders, solving cancellations or problems of any nature related to an Order, the Goods and/or services purchased, as well as sending Newsletters if the client has opted for this and/or periodic alerts, via electronic mail (email, SMS)

By filling in the data in the Account creation form and/or Order form, the Buyer declares and unconditionally accepts that their personal data be included in the Magic Hub SRL database.
By reading this document, you acknowledge that you are guaranteed the rights provided by law, such as the right to information, the right of access to data, the right to intervention, opposition, and deletion.

Through a request sent by the contact form while logged in to your client account, you may exercise your right to know whether your personal data is processed, request intervention, rectification, updating, anonymization, blocking or deletion of data where processing is not compliant with Law 677/2001 on protection of personal data and free circulation of such data, especially if the data is incomplete or inaccurate. More details can be found below in the section Your Rights.

To offer a personalized experience on our website, Magic Hub SRL may store information regarding cookies, IPs, ISP information (Internet Service Provider), the browser used (e.g. Internet Explorer or Firefox), the date and time of visit, and information about visited subpages.

Magic Hub may provide Buyer personal data to partner companies in order to fulfill the concluded contract (e.g., courier companies). Buyer personal data may also be provided to Prosecutor’s Office, Police, courts, and other authorized state bodies based on and within legal limits and upon express request.

Your Rights

Right to rectification of personal data
You have the right to rectify data held about you if they are incorrect. If the data we hold about you need to be updated or if you believe they may be incorrect, you may log into your client account to update them or contact our team via the contact form.

Right of access to personal data
You have the right to request a copy of your personal data held by us. To submit this request as an individual or authorized third party, please use the assistance form on our website, section Contact.

Right to data portability
You have the right to obtain the personal data you provided from the moment you became our client. All data relating to orders or provided addresses can be found in your account. Contact us if you wish to receive them in another format than the one provided by our system.

Right to object to personal data processing
In certain circumstances, you have the right to object to Magic Hub processing your personal data. If applicable, please send us a message using the assistance form in the Contact section.

To stop receiving marketing messages:
If you no longer wish to receive marketing messages from Magic Hub regarding our services and products, you may opt out of all marketing communications.
There are several ways to unsubscribe:

• Log into your account and access the options in Personal Information menu
• Contact our team through the contact form
• Click the unsubscribe link at the bottom of any marketing email

If you unsubscribe from marketing messages, this does not mean you will stop receiving messages related to services contracted on our website (e.g. order confirmations).

Right to restrict the use of your personal data
If you believe the data we hold about you is incorrect or you believe that we should not process your data, please contact our Customer Relations team. In certain circumstances, you will have the right to request restriction of processing.

Right to deletion
Magic Hub aims to process and retain your data only as long as necessary. You have the right to request deletion of your personal data held by us. If you believe we store your data longer than necessary and if no legal exceptions apply, you may request deletion by sending a message through the contact form.
